Notice to All Short Term Rentals in Lido Shores



Dear Lido Shores Property Owner:

On November 5, 2018, the LSPOA Board of Directors unanimously approved a LSPOA By-law restricting membership for those who rent their home for less than 30-consective days, or one-calendar month (whichever is less).  Notice of the new short-term rental restriction was given in an article published on November 7, 2018 on our Lido Shores website, as well as updated under the “Rules” tab on lido-shores.com.

While some owners have voluntarily either taken their properties off of the rental market or changed their rental times to comply with our new By-law, others have not. The purpose of this letter is to give notice to all LSPOA members still engaged in short-term rentals. 

This was a particularly unpleasant summer in Lido Shores with numerous instances of disruptive behavior at rental properties including:

  • violations of noise, parking ordinances and underage drinking 
  • parties and/or takeovers of our pavilion with trash and cigarette butts left behind
  • numerous overflowing trash bins set at the curb on the weekend for all the neighbors to see and smell until they are picked up on Tuesday morning (which is also a Sarasota City Ordinance violation)
  • other behavior that negatively impacts our neighborhood.

For Lido Shorians who live here, our peaceful, private neighborhood and beach that attracted us is transforming into a destination for summer tourist and vacationers. Allowed to flourish, this pattern would change the residential character of Lido Shores, similar to Anna Maria or Siesta Key. 

We understand that this party-like vacationers’ behavior is not the intention of those renting their homes as short-term rentals. However, it is the reality of the situation, and those of us actually living here are suffering the consequences.

In an attempt to curb this behavior, and protect our private beach access from transient visitors renting Lido Shores homes for less than one-month, the LSPOA Board of Directors will be enforcing the By-law passed 10-months ago. Homeowners currently renting their Lido Shores property or properties for terms shorter than one month (or 30 consecutive days) must cease short-term rentals as of January 1, 2020. If short-term rentals continue beyond January 1, 2020, then the owner of the subject house(s) will forfeit their LSPOA membership(s), and their beach access will be terminated. 

Owners who advertise or promote Lido Shores rentals of less than one month or 30-consecutive days will receive a warning, followed by membership termination if their house continues to be listed as a short-term rental. 

All warnings will be issued by telephone, email or U.S. Mail.  Holders of terminated memberships will be given the opportunity to reapply for LSPOA membership when they comply with the rental term rules.

LSPOA By-Laws Regarding Short Term Rentals (Updated November, 2018)

II : 4.0 Termination of Membership - Membership in the Association shall terminate whenever the member concerned:
II : 4:1 Ceases to be a title holder of record of real property located in Lido “C” Subdivision, or as associate member ceases to be a title holder of record of real property of a lot entitled to associate membership, or as tenant member ceases to be a lessee of a lot that qualifies for membership or associate membership, or

II : 4.2 Fails to maintain a single-family home in keeping with the residential character of the neighborhood, or
II : 4.2a Rents a single-family home (or any portion of) for less than 30-consecutive days, or one calendar month (whichever is less), or
II : 4.2b Operates home solely as a business or rental business.
II : 4.3 Has been found by the Board to have:
II : 4.3a Consistently violated the express terms and conditions or spirit of the Association’s charter and/or By-laws, and/or the terms and conditions of a certain easement and right-of-way recorded in book 1215, Page 1001, Sarasota County Official Records, and/or:
II : 4.3b Engaged in conduct deemed by the Board in its sole discretion to be inimical to the orderly transaction and management of the Association’s business affairs or to the peace, tranquility and general good order of the Lido “C” Subdivision neighborhood including residential areas immediately contiguous thereto. (Such conduct would include, but is not limited to:  loud or excessive noise or parties, renting a single-family home for less than 30-consecutive days, or 1 calendar month (whichever is less), using premises solely as a rental business, allowing dogs to defecate on others lawns and/or in public right of ways without properly disposing of waste, failing to maintain and upkeep premises, failure to maintain landscaping).
